EU GDPR and UK Data Protection Laws – Legal bases
The EU GDPR and UK data protection laws require a legal basis for our use of personal information.
Contractual obligations
In order to complete a transaction, it is necessary for us to collect certain personal information. This includes the information that we need to know where and to whom to send any physical or electronic copies or information, for billing purposes, to register your place at an event and to record any relevant CPD accreditation. Where you subscribe or register an account with us, we have a contract with you to provide those services and facilities.
Community members are able to engage and interact with each other through the website and other forums. This is a voluntary process and users have control over most of information provided except to the extent that it is necessary to provide the service, and personal data may be shared to enable this functionality. In some cases, we will ask for your permission to enable us to collect and use your data in specific situations if you do not wish us to use information in that way, contact us at info@pesi.co.uk.
Legal compliance
If the law requires us to, we may need to collect and process your data. For example, if required to by the UK police force, we may have to pass on information to you if an official request is made.
We will process personal data for legitimate business interests to enable the day to day function and operation of our business, to manage and provide our services and the online activities and events, and to develop the business and keep the online services updated and relevant, and understanding our customers and their behaviour to provide the service they would expect.
We will use some personal information to support business development to inform you of events or new products or by monitoring and improving our services. We will try to minimise the level of data that we collect and use to what is reasonable to enable us to do so, and in some cases we will use information that you have voluntarily provided to us. We will always try to ensure that our use of information is clear, and appropriate to running our business, and balance our business interests with your privacy. This does not impact your rights, freedom or interests.
What personal information does PESI UK collect?
In order to provide our products and services, and operate our business, PESI UK will collect and use a range of personal information:
- Account information including name, address, telephone number, job title, email address, password and account image.
- Payment information to manage purchases.
- Details of CPD events attended and contributions to such events.
- Order details.
- Information on downloads, streams, views, or use of content on a device, or through a service or application on a device.
- IP address and location information.
- Details of your interactions with us through contacting customer service by phone or email.
- Copies of any documents you provide to prove you are a student or a member of an organisation.
- Details of your visits to our website and where the visit originated (e.g. search engine, email, link, IP address, etc…).
- Information gathered through the use of cookies in your web browser.
- Onsite browsing behaviour.
When Does PESI UK collect Information?
- When you create an account with us, purchase products, register for events or watch content.
- When you purchase a product by phone.
- When you engage with us on social media.
- When you download or install one of our apps.
- When you contact our customer service department by email, chat or telephone with queries, complaints, feedback, etc.
- When you comment or review our products.
- When you fill in any forms on the website.
- When you add a job to our jobs listing.
- When you add an event to events listing.

The primary purpose for collecting and processing personal information is to provide our online and in person CPD materials and events. This includes the books and materials you can purchase, as well as our events and conferences, and is also used to issue and monitor CPD certificates.
We also use your data to provide you with an excellent customer experience and inform us about the service we supply and how this can be improved. We use aggregated information to monitor and improve our services.
Whilst some information is collected automatically, in many cases the information is obtained from you directly when you interact with our services and contribute. Where failing to provide information will impact on the service we can supply to you, we try to ensure that this is clear.
We may use your data in the following ways:
- To process any orders that you place through the website. If we are unable to collect the personal data we require during checkout, we won’t be able to process your order and comply with our legal obligations. Please note: your details may need to be passed to a third party to deliver any books, flip charts or DVDs that have been ordered.
- To inform you of upcoming and events, products, and promotions that we feel may be of interest.

- To apply the correct discount at checkout

Do you share personal information?
At PESI UK we will share certain personal information with our third party professionals, suppliers or contracts to enable us to deliver our services to members, to deliver products which are ordered, and in the fulfilment of online and in-person events, and to protect or enforce our legal or contractual rights.
We may share personal information with members of our Group Company, including our parent company which operates overseas, in order to support our UK and European business operations.
Some limited information is available to third parties, including advertisers, through the cookies on our website as part of our analytics and search engine optimisation.
Where we partner with other organisations to provide events and conferences, we will invite you to consent to sharing information with that partner.
We may share information on CPD certificates and courses at the request of an employer or a regulator or as part of an investigation in accordance with our legal responsibilities.
How do you store and protect my data?
We may transfer and store personal data at a location outside the UK and EU, and data may be processed by staff operating outside the UK and EU, including to the US where our parent company operates. When we transfer personal data outside of the UK or EU we have appropriate measures in place, in accordance with the UK GDPR and EU GDPR to ensure the protection and security of that data. We have measures in place to ensure that staff are aware of privacy issues and good data handling practices as your privacy is important to us. We use a number of technical and organisational measures to help keep information secure and protected and to prevent unintentional loss, misuse, alteration or disclosure - including:
- We do not store any payment information in your account unless there is a payment plan in place.
- All data is stored in a securely and all accounts can only be accessed using an email address and password.
- We use ‘https’ technology for all transactional areas of our website.
- We regularly monitor our systems for possible vulnerabilities and attacks.
- All staff are trained how to handle data securely.
- All transactions are PCI compliant.
Where you have a password to access your PESI UK account, we ask you to keep it confidential to help us maintain your privacy and protect the information.
How long will you keep my data?
We will generally hold personal information for the whole time that you have an account or membership with us and for up to 6 years after, and to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws or provide proof of CPD to employer), resolve disputes, and enforce our legal agreements and policies.
We will also retain Usage Data for internal analysis purposes, where possible this is held in an aggregated pseudo-anonymised format to protect individual privacy, and this aggregated data may be held for up to 6 years to enable us to monitor and improve performance of our online presence and activities.
As some of our CPD products come with a lifetime guarantee your order and account will remain on our database.
When you request an account closure, we may have to retain information about your orders to comply with UK law, however, you will be informed of any issues during the cancellation process.
Where is my data processed and stored?
Your data will be processed outside of the UK and EU by our parent company, who is based in the US – this is necessary to enable us to process your orders and provide the products and services your request.
Where we transfer personal data outside of the UK or EU, we have appropriate measures in place, in accordance with the UK GDPR and EU GDPR to ensure the protection and security of that data. Any transfer of your personal data will follow applicable laws and we will treat the information under the guiding principles of this Privacy Notice.
We are committed to respecting the confidentiality of personal data that is within our control, and to ensuring a fair process to enable our members and users of our services are able to exercise the rights that are set out in law. The UK GDPR and the EU GDPR set out various rights for individuals that can be exercised in different circumstances, including:
- Request access to Your Personal Data. You have the right to access, update or delete certain information we hold about you. You can access, update or request deletion of your personal data within your online account with us. If you are unable to perform these actions yourself, or you wish to request copies of your personal data that we hold please contact us to assist you. Whilst you are able to delete records from your online account, this may not delete all records that we hold, and we may continue to keep records to comply with our legal obligations, or where they relate to any contract that we hold with you.
- Request correction of the Personal Data that we hold about you. You have the right to have any incomplete or inaccurate information we hold about you corrected. You can manage some of this information via your account setting, or please contact us to assist you, and we will support you to the extent that we are able in accordance with the law.
- Object to processing of Your Personal Data. In certain circumstances you have the right to object to certain of our activities in the way we use your personal data. This is not an absolute right, but if you wish to exercise it, we will give due consideration to such request in accordance with the law. If you wish to opt-out of receiving certain marketing information, please contact us to assist you.
- Request erasure of Your Personal Data. You have the right to ask us to delete or remove Personal Data when there is no good reason for us to continue processing it.
- Request the transfer of Your Personal Data. In certain circumstances you may request that we transfer certain personal data to a third party, please contact us for more information if you would like to exercise this right.
- Withdraw Your consent. Where we are solely relying on your consent as our lawful basis for processing your personal data, you have the right to withdraw your consent. If you withdraw your consent, we may not be able to provide you with access to certain specific functionalities of the service.

Exercising of your GDPR Data Protection Rights
If you wish to exercise your rights of access, rectification, cancellation, and opposition please contact us; we may ask you to verify your identity before responding to such requests. If you make a request, we will try our best to respond to you as soon as possible, and to accommodate your request within the legal framework.
You have the right to complain to lodge a complaint with the Information Commissioner’s Office if you feel that your data has not been handled correctly, or you are unhappy with our response to any requests you have made to us regarding the use of your personal data.
